1. GENERAL TERMS AND CONDITIONS

The General Terms and conditions apply to all usage by online visitors and orders placed by customers of www.albalo.se. By accepting these terms and conditions, you enter into an agreement with Albalo AB, org. nr. 559341-8618 (hereafter Albalo). It is the obligation of the buyer to accept and take notice of the terms and conditions before placing an order. By placing an order on www.albalo.se, the customer enters into an agreement with Albalo and accepts these General Terms and Conditions. Albalo reserve the right to modify the General Terms and Conditions. You are asked to accept the General Terms and Conditions applicable at the time of purchase with each order. Any changes made after you have placed an order will not affect that order unless required by law.


2. APPLICABLE LAW

Any and all disputes arising in connection with The General Terms and Conditions or with the use of the website or with any purchase on the website shall be governed by applicable Swedish law. As a customer and user of the website, you are obliged to comply with all applicable national and international laws and regulations regarding your use of www.albalo.se.


3. OWNERSHIP OF RIGHTS

All rights, including but not limited to copyrights, at www.albalo.se remain with Albalo. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal and non-commercial use, is prohibited without Albalo’s permission.


4. ORDER

Before proceeding to paying your order, you can review your order, including your total price (including taxes and shipping charges). You are bound by your order from the moment you confirm the order and the General Terms and Conditions by submitting the order. This occurs once the payment is confirmed. Please note that the order will not be valid if Albalo cannot confirm the billing and shipping address(es) provided by the buyer. Once you have confirmed your order, you will receive an immediate online confirmation on your screen at the end of the checkout, as well as a digital order confirmation via e-mail. You will receive a digital delivery note via email when your order is shipped. This is a confirmation of your delivery. Albalo only sell items that are in stock. Garments may sell out of stock during the shopping session and stock availability will be updated once you reach the checkout. We cannot guarantee item availability after an item is sold out. We reserve the right to alter/change/cancel an order in the event that stock levels have been incorrectly displayed by the time of the order placement. Prices online are stated in the following currencies: SEK, EUR or DKK. Albalo reserves the right to update prices on www.albalo.se if necessary. Albalo cannot be held responsible for any currency changes or changes in exchange rates. All product information displayed on www.albalo.se may be subject to change.


5. DELIVERY AND FREIGHT

The shipping country is chosen at checkout. All prices, currencies, VAT/taxes, delivery times and delivery charges will be adjusted depending on the country you would like your items shipped to. Albalo will dispatch the approved orders within 2-4 working days (Monday – Friday) or as quickly as possible and in the order that they have been received. Exceptions may occur during for example bank holidays, sale periods or inventory management. Estimated delivery times are to be used as a guide only and commence from the date of dispatch. Delivery times are dependent on the country where goods are shipped to and the freight method. Albalo is not responsible for any delays caused by destination customs clearance processes. If a delivery suffers a delay or if the delivery cannot be dispatched or only partially dispatched due to the goods not being in stock or other reasons, the consumer will be informed about this as soon as possible or at the latest 30 days after the order was placed. In this case, the consumer will be given the option to terminate the agreement free of charge. Albalo will refund the customer in full, at the latest within 30 days after termination. The shipping cost is stated in SEK, EUR or DKK and is determined based on the package's weight and country of delivery. Albalo is not responsible for packages that are not collected from postal agents. In the event of a return which means that the postal agent returns the order and the return is caused by the customer, the customer will be charged for the cost of return shipping plus administrative costs. If, upon receipt of your package, you discover that the consignment is visibly damaged during transport, this must be reported to the carrier immediately. This applies both to home delivery and when you pick up the package yourself from a postal agent. If you discover during unpacking that the contents are damaged or that goods are missing, you as a customer are obliged to contact Albalo's customer service no later than within 7 calendar days of receiving goods with your order number and case number from the parcel agent. In the case of return transports of products, the customer has the financial responsibility if the products are damaged or do not arrive.


6. FAULTY GOODS AND/OR FAULTY INFORMATION

If the customer receives order(s) that are wrong and/or duplicated, Albalo reserves its right to get back all products in its original condition. The customer has to return the goods to Albalo within 14 days of delivery with no exceptions. Albalo will compensate the cost of shipping. In the event of products being sold due to incorrect pricing caused by technical problems and/or mistakes by Albalo, we reserve the right to cancel the order, refund the money and inform the customer of the situation.


7. CANCELLATION AND RIGHT OF RETURN

For orders going within the EU, the customer has the right to cancel and return a purchase within 14 calendar days from the time the order has been delivered. Returns must first be approved via email with Albalo, after which a return slip is sent to the customer. The package must be franked with this return slip. For all returns, a return fee will be charged from the refunded item value. The refund fee is 49 SEK, 90 DKK or 12 EUR depending on country. For a return to be approved, the following requirements must be met. The product is returned in salable condition, in the product's original packaging. Any labels and tags must remain on the garments. Products that are used, damaged, dirty, washed or worn are not accepted. The package must be franked with a return label containing order number and contact information for our warehouse. Goods or packages that can not be identified may be refused approved return and refund. When returning several items from an order, all items must be returned in one package. The customer is responsible for the return until the package has been received and registered in our warehouse. If the return is not approved, a full refund will not be received. We handle returns within 30 days of receiving the package in our warehouse. Once the return has been handled and approved, the refund will be made using the same payment method used at the time of purchase. It can take up to 5 banking days before the refunded amount is available in the customer's bank account. The return fee will be automatically charged from the refunded item value for all returns. A confirmation email will be sent to the customer when the return has been approved and refunded. If there are problems or questions regarding a return, the customer will be contacted. If a return is denied because the requirements above are not met, Albalo cannot guarantee that the product will be returned to the customer.


8. COMPLAINTS AND CANCELLATION DUE TO DEFECTS

If you discover a fault or defect in the purchased items, a complaint can be brought and the goods returned for a full refund. Items that are damaged as a result of normal wear and tear are not considered to be faulty. Where possible, Albalo will offer to repair faulty items. If the items cannot be repaired or the same product is not available for re-order, you are entitled to a full refund including costs of shipping and return. Albalo follows the Swedish Consumer Purchasing Act (Konsumentköplagen) in the event of complaints. The customer is responsible for unpacking and checking that the products in the delivered package are faultless within 7 days of the order being delivered. Should a product be damaged, broken, dirty or otherwise defective upon delivery, a complaint must be made via our customer service. In the event of a complaint about purchases made on www.albalo.se, customer service must always be contacted before a complaint is sent in return. Customer service decides if it is an approved return and then gives instructions on how to send the complaint to our warehouse. Complaints submitted without approval or contact with customer service may be refused a refund. In the event of a negative complaint, Albalo cannot guarantee that the product will be returned to the customer. You have the right to complain about an item purchased on www.albalo.se within 3 years against a valid payment basis.


9. CHANGE OF ORDER

Once you have completed a purchase and received an order confirmation, we will start processing the order in our system and in our warehouse. Once the package has left the warehouse, there is no possibility to change your order. If you discover errors in the specified contact information, it is your duty to contact customer service. Albalo is not responsible for orders sent to an incorrectly stated address by the customer.


10. EXCHANGE OF GOODS

We do not offer exchanges. If you want to exchange goods in an order, the customer is asked to make a return and place a new order with the right item. For returns, all requirements under 7. CANCELLATION AND RIGHT OF RETURN (see above) must be met.


11. FORCE MAJEURE

In the event of force majeure, our obligations are postponed via www.albalo.se. In the event of force majeure, both the customer and Albalo have the right to terminate, in whole or in part, any agreement without any obligation to pay damages or fulfill any obligations. By force majeure we generally mean, but not limited to, natural disasters, wars, strikes, import / export bans, transport disruptions and illness at Albalo or with our suppliers.


12. FRAUD

Albalo reserves the right to cancel and refund all orders that are suspected to have been carried out in a fraudulent or otherwise harmful manner in order to ensure the security of our consumers' transactions via www.albalo.se. We reserve the right to pass on transaction information if necessary to official authorities or a payment partner in the event of suspicion of fraudulent transactions or identity theft. Individuals who violate the above rules or against the restriction of password-protected areas on www.albalo.se will be reported to the police.
